These terms and conditions ("Terms") govern the use of the e-learning services provided by Miracamp/Bestapeople ("the Company"), an e-learning company offering Courses for sale to individuals or businesses worldwide. By accessing our e-learning platform, purchasing our Courses, or using any of our services, you ("the Student") agree to be bound by these Terms.
Miracamp is an online school published by Bestapeople, a French legal entity. Bestapeople is a company registered at 86 RUE DU FBG SAINT DENIS 75010 PARIS under the identification number SIREN 917893398.
1. Course Access and Usage
1.1 The Company provides access to e-learning Courses and educational content ("the Courses") through its online platform. Students are granted personal, non-transferable, and non-exclusive access to the Courses for their individual educational purposes.
1.2 The Student agrees not to download, copy, reproduce, or share any course materials, including platform access, with any third party. The Company takes violations of this provision seriously and will impose high penalties and legal charges if any student is found to be in breach of these terms. Any unauthorised distribution, reproduction, external usage, sharing of platform access, or replication of course materials will be subject to immediate termination of the Student's access without refund, and the Company reserves the right to pursue legal remedies to seek damages for infringement of its intellectual property rights. By accessing the e-learning platform of the Company, purchasing its courses, or using any of its services, the Student acknowledges the severity of these consequences and agrees to comply with these Terms and Conditions accordingly.
1.3 The Student is granted lifetime access to the Courses, subject to the Company's management discretion. The Company reserves the right to revoke access with a three-month prior notice.
2. Preorder and Pricing
2.1 The Company offers the option for Students to preorder courses by making a security deposit (also called Pre-Order). Preordering guarantees the Student access to the course at any time.
2.2. The price charged for the course will be the price displayed at the time of the preorder.This provision ensures that those who have proactively engaged in the preorder process will not be impacted by any price increases that may transpire after the initial transaction.
2.3 In the event that the Company decides to revoke access to a course with a three-month prior notice, the Student will be refunded the preorder amount.
2.4 Pre-Order status will remain active for a duration of six months from the date of initiation.
After the six-month period elapses, preorders will be automatically considered part of the Company's revenues. This transition is essential for financial record-keeping and operational planning.
This clause elucidates the Company's adherence to transparency and its commitment to maintaining accurate financial records, while simultaneously affording Students a clear understanding of the temporal limitations inherent in the Pre-Order mechanism.
3. Instructor Availability and Responsiveness
3.1 The Company provides instructor support 24/7 but does not guarantee immediate availability or response times. The availability and response times may vary depending on the instructors’ schedule and workload.
Teachers may also suggest coaching sessions or video calls to students when they are available and believe it is pertinent to the student's overall learning experience.
3.2 After completing the courses, up to 4 dedicated coaching sessions can be planned. Coaching sessions will be conducted via video call by selected company members. These coaching sessions aim to assist Students in launching their careers, leveraging their editing skills or improving their online presence.
3.3 Any failure to attend a scheduled meeting or cancellation less than 48 hours before the planned interaction will be considered as utilizing the given coaching slot.
3.4 For students joining the Basic offer of the Courses, no coaching session before or after graduation will be provided.
4. Instalment Plan and Payment
4.1 The Student's payment information during the order and payment by credit card is subject to automated data processing by the secure payment provider STRIPE, and the Company reserves the right to use any other payment service provider (PSP).
4.2 The Company offers an instalment plan for Course payment, with options for a six-month or three-month payment period. The Student may choose their preferred payment plan at the time of enrollment.
4.3 Failure to make timely payments under the instalment plan may result in penalties imposed by the Company. The Company reserves the right to escalate actions, including legal remedies, to recover outstanding amounts.
4.4 Payment Obligation:
a. The Student acknowledges and agrees to fulfil their payment obligations as per the agreed-upon instalment plan for the online Course.
b. The Student understands that failure to make timely payments as per the instalment plan may result in the termination of access to the Course, platform, and job guarantee.
4.5 Access Suspension:
a. In the event of non-payment, the Student's access to the online Course, learning materials, and platform will be temporarily suspended until the outstanding payment is resolved.
b. The Student will be notified of the payment default and given a grace period to rectify the payment issue.
4.6 Reinstatement of Access:
a. Upon full payment of the outstanding amount, the Student's access to the Course, platform, and job guarantee will be reinstated.
b. The Student understands that any time lost during the access suspension period will not be compensated or extended.
4.7 Other Remedies:
a. The suspension of access due to non-payment does not relieve the Student of their financial obligation.
b. The Company reserves the right to pursue additional remedies, such as legal action or debt collection, to recover any outstanding payments.
4.8 The Company may offer a commercial guarantee of "satisfied or refunded during the first 7 days" when placing an order. If specified on the website at the time of the Student's order or if agreed with a Program Manager, the Student who is not satisfied with the Course has the option to be fully refunded after validating the order. This guarantee applies under the condition that the Student has viewed a maximum of 10 of the Course videos.
Upon request for a refund, the Company commits to initiating the refund process within 48 hours. The actual receipt of the refund by the Student is contingent upon the processing timelines of the designated payment provider and may take between 5 to 10 days.
5. Intellectual Property Rights
5.1 All intellectual property rights, including copyrights and trademarks, related to the Courses and the Company's e-learning platform, are owned by the Company or its licensors. The Student agrees not to infringe upon or misappropriate any of these intellectual property rights.
6. User Content
6.1 The Company may provide features that allow Students to submit or upload user-generated content, including assignments, projects, or discussions, to the e-learning platform. By submitting such content, the Student grants the Company a worldwide, royalty-free, non-exclusive, and transferable license to use, reproduce, distribute, display, and modify the content for the purposes of providing and improving the e-learning services.
7. Certificate
7.1 Upon successful completion of the program, the Company extends a certificate to its students. Certificate eligibility is contingent upon reaching a sufficient proficiency level, as confirmed by the teachers of the Online School. Students must meet this specified level to qualify for the certificate.
7.2 Students who have not attained the required proficiency level are not eligible to request a certificate. This stringent criterion is in place to uphold the integrity & prestige of the overall program and the community of graduates and students.
7.3 The Company does not issue a diploma or certificate recognized by the State, such as MBA, bachelors, university degrees, or others. The Company does not act as a training organization within the meaning of the labor code.
8. Other
8.1 All students, members, and representatives associated with the Company are expected to maintain a respectful and polite behavior at all times. Any form of disrespectful or inappropriate behavior will not be tolerated.
8.2 The Student is informed that the Service may require access to other sites or platforms, designed and managed under the responsibility of third parties. Any recommendation is provided for informational purposes only, and the Company disclaims any liability for any shortcomings of third parties, including recommended ones. Unless otherwise stated in these General Conditions, the Company has no control over the content of these sites and disclaims all responsibility regarding their content and any third party's use of the information contained therein.
When the User accesses third-party links through hypertext links present on the Sites to Partner sites, these are not governed by these General Conditions. Therefore, the User is invited to review the terms of use or sales, as well as privacy policies or any other legal information applicable on these sites.
8.3 In pursuit of mastering video editing through the program, potential supplementary expenses beyond the program fees can be recommended (video editing softwares, additional tools…). The access to & usage of these tools are neither encompassed within the base program fees nor the responsibility of the Company.
8.4 The Company reserves the right to terminate the Student's access to the e-learning platform and Courses in the event of any violation of all the listed Terms. Termination may occur without prior notice and may result in the forfeiture of any fees paid
